LEGAL WORKING GROUP MEETS IN PARIS

On Monday 15 December 2008 the Members of the Legal Working Group will meet in Paris by invitation of the French Member Association FNAC. Issues to be discussed are:
- the draft document prepared by the Legal Advisor of the Austrian Member Association which includes a proposal for amendment of Art. 5 of EC Regulation 44/2001;
- update on EuroCommerce Working Committees activities;
- EC Regulation 593/2008 of 17 June 2008 which shall replace the 1980 Rome Convention of the law applicable to contractual obligations;
- opinion of the Advocate-General of the European Court of Justice of 19 November 2008 in the case Turgay Semen versus Deutsche Tamoil in which a preliminary ruling has been requested;
- the English High Court decision of 23 April 2008 in the case Nigel Fryer versus Ian Firth Hardware;
- judgement of the Scottish Court of Session of 5 August 2008;
- judgement from the Swiss Supreme Court of 22 May 2008 according to which a distributor may, under certain circumstances, successfully claim payment of a goodwill indemnity.
