NEW COMMISSION PROTECTION ACT IN NEW JERSEY (US)
by Secretary-general Mr. J.W.B. Baron van Till:
One of the strong Member benefits of MANA is the successful lobbying for enacting legislation in each State of the US that require the timely payment by the manufacturer of the due commissions and provide for consequences for failure to do so.
On 14 January 2008, the Governor of the State of New Jersey signed into law a new Commission Protection Act. It was a close call as the bill passed both Chambers the last day of the session. Public Strategies Impact, the lobbying firm retained by MANA to get the legislation enacted, did a great job in getting this bill through. Information on all the current Commission Protection Acts can be found in the Member area of the MANA website (www.manaonline.org).
Information about the legal aspects relating to the sales representative in the US can be found in the IUCAB Legal Fact Sheet “The Sales Representative in the United States of America”, which has been written by Mr. Florentino Ramirez, legal advisor of MANA and Member of the IUCAB Legal Working Group. A brochure can be obtained from the IUCAB Secretariat in Amsterdam.
